Missing guru sentenced to 280 years in prison

An influential Hindu guru, who vanished and is still missing, received 280 years in prison Tuesday after being found guilty last week by a Hays County jury on 20 counts of sexual indecency with a child.

Prakashanand Saraswati, 82, received 14 years in prison per count and fines of $10,000 per count for a total of $200,000. It’s still unknown if the jail time will run concurrently, court officials say.

Two felony arrest warrants were issued Monday for Saraswati, who was convicted of all charges by the jury of eight men and four women, which took only two hours to deliver the guilty verdict Friday evening and even less time to sentence him Tuesday afternoon.

As of Tuesday, Hays County Sheriff’s Office deputies were actively searching for Prakashandand, believed to be with his personal assistant, Vishwambhari Devi, who drove the guru to court last week.

Known as Shree Swamiji by his devotees, Prakashanand was arrested in April 2008 and charged with touching the breasts of two then-minor girls between 1993 and 1996 while they lived at a Driftwood area ashram. Prakashanand runs the ashram and is the spiritual head of the JKP-Barsana Dham temple on site.

Each indecency count, a second-degree felony, carried a punishment between two and 20 years in prison. Prosecution and defense attorneys pushed through the punishment hearing despite the defendant’s absence.

On Tuesday, with Prakashanand absent, assistant district attorney Cathy Compton asked the jury for the maximum sentence – 20 years for each of the convictions. His defense attorney asked for probation because his frail health would amount to a death sentence.

No idea where he is
Infomercial mogul Peter Spiegel, the treasury secretary for Barsana Dham, testified on Tuesday that he did not know where Swamiji or Devi had gone.

“I have no idea where he is,” said Spiegel, who added that he saw the guru on Sunday night and there was no indication that he would not show up for court the next day.

Spiegel has already lost the $1 million cash bond he posted last week to keep the guru out of jail until after his sentencing. Spiegel also secured a $10 million personal bond in 2008 to allow Swamiji to travel to India while awaiting trial. In October, Swamiji, a naturalized U.S. citizen, surrendered his passport under orders from 22nd District Judge Charles Ramsay, officials say.

When Swamiji failed to appear, Ramsay revoked the cash bond and issued warrants for his arrest. Prosecutors hinted that Spiegel, who has amassed a fortune in part by selling ionic air purifiers, health supplements and other products via television and telemarketing, could be responsible for the entire amount.

“I really don’t know technically and legally of my situation now,” Spiegel testified.

It’s unknown if the guru has fled to India. Spiegel told the court that Swamiji does not have an Indian passport. Additionally, India does not allow dual citizenship.

Closing arguments
In Friday’s closing arguments, assistant criminal district attorney Amy Lockhart told the jury that Swamiji had used his power as a religious leader to grope these girls for his own gratification.

“We want to show you that he had the power, love and trust and he abused it,” she said.

Lockhart explained that the girls saw Swamiji as a god and could not question his acts.

The first accuser, now 30, said that the alleged abuse began when she was 12 years old.

“She thought it was impossible to outcry against a god,” Lockhart said. “She was told that it was a test and if she failed she would go to hell.”

Similar abuse initially occurred to the second accuser, aged 27, when she was also 12 years old, said Lockhart, who claimed that Swamiji exploited the girl’s trust by kissing her with his tongue and fondling her breasts numerous times.

“She believed that he must have had a divine reason for this,” she told the jury.

As an attempt to debunk the defenses witnesses who testified that the girls were habitual liars and Swamiji was never alone with them, Lockhart hinted that the witnesses were also being used by a so-called saint.

“These people are still devoted to him,” she said. “Barsana Dham is the perfect breeding ground to exploit love and trust.”

Reasonable doubt?
Defense attorney Jeff Kearney said the charges against his client couldn’t be proven beyond a reasonable doubt.

“I really don’t think you can do that in this case,” Kearney, of Fort Worth, told the jury. “That decision has to be on law and evidence, not a gut feeling.”

He argued that the prosecution wanted the jury to convict his client on the stories of three untruthful women, with no other evidence to support their claims. The third woman, aged 31, testified that the guru also groped her; however, she is not one of the named accusers because the statute of limitations ended before she could press charges.

Kearney then said that the accusers’ stories were too consistent and fabricated. When the defense tried to question the accusers, he said, they would become uncooperative and get “instant amnesia.” He recounted the first accuser skirting past defense questions more than 110 times, while the second accuser did it more than 50 times.

“Are they trying to sell you something?” he told the jury of the prosecution’s case.

He also questioned the testimony accusing Swamiji of molesting them hundreds of times. Two of the accusers are sisters and all three were best friends who lived together in a small community but had never discussed the abuse, he said.

“There are unanswered questions,” he said of the case. “It’s a made-up story.”

Defense attorney Angelyn Gates, another lawyer on the guru’s far-flung defense team – Prakashanand had at least a dozen lawyers working on his behalf – then argued that the accusers had a motive for coming forward, and it wasn’t to save children from abuse.

“They did not come forward to save the children, but came forward when there weren’t any children left [at Barsana Dham],”she said.

Gates painted a picture of a family feud among the two accusing sisters and their family, which still lives on the ashram. In addition, all three accusers were already ashram outcasts when they decided to file police reports in 2007 while they were all living in Seattle, Wash.

Gates added that Swamiji had taken a vow of celibacy and devoted his entire life to his spirituality.

“All you have is three girls who were shunned away,” she told the jury.

‘Use your gut’
Compton concluded closing arguments by asking the jury to ignore what she termed the defense’s misdirection tactics. Kearney objected multiple times during Compton’s arguments, requesting a mistrial at least five times.

Compton claimed that Swamiji does not live a simple life at the ashram, as defense witnesses had testified earlier.

“He sits on a throne. He has a servant,” she said. “He’s hanging out with millionaires and going to Las Vegas.”

Compton also added that most sexual abuse cases have only one victim – this case has three.

“Use your gut,” she told the jury. “You know the truth.”

Throughout the trial, an elderly Swamiji listened to testimony in a reclining brown chair to rest his bad back. He recently had back surgery, which stalled the trial last year until a doctor could medically clear him for court.

Plainclothes security from the Hays County Sheriff’s Office also sat behind the prosecutor’s desk as security was heightened for the high-profile trial.

    Sad to say that Prakashanand Saraswati is not the only so-called holy man who abused people’s trust. Nithyananda Swami is facing even more serious charges of rape. It is very sad when sex criminals take advantage of people’s faith and use world religions as a means to commit their crimes. I hope the good court makes an example of this sex criminal. This will give pause to other fake gurus who plot to do the same.

    Okay…. so how much hard cold cash is the 10 million bond really? And where do these funds now go? Is Hays County going to be the beneficiary of Judge Ramsay’s somewhat head-scratching choice to allow this defendant to (a) have a bond when such a flight risk and (b) not hold him in custody after the guilty verdict? I think I posted on a previous articel about this defendant that is must be nice to have friends with can post 10 million dollar bonds!

    In defense of His Honor, I think it ought to be recognized that the guru can still file an appeal and be eligible for a bond under that appeal. I also wonder if the court is going to imprison the Guru. At his age and given his health there might be some sympathy for placing him under house arrest with an ankle bracelet. I think Judge Ramsey can impose the sentence with the agreement of the defense without a hearing before the jury that delivered the verdict. ((((Somebody clarify this, please))))

    I am told that this type of criminal is the most difficult to reform. Of course, I don’t know if he is a pedophile or a dirty old man. At any rate, he is clearly a predator and a sicko.

    So many people have fallen under the spell of these “leaders” who are nothing but predators. The tragedy is that it tends to undermine the good work of so many honorable coaches, scout leaders, ministers and others who want to make a difference in the lives of people.

    Dealing with these people requires an understanding of human nature that is beyond my ability to understand.

    Wow! A spritual leader give $10,000,000 for free brest cancer exams for his young flock. How much will our governor give for prostate cancer examinations for his flock?

    Little doubt on this one: Hays County may get a forfeiture, but it won’t be ten million dollars and it will surely not go for cancer exams. I also would not be surprised that he has been in a “coma” off somewhere and when he reappears he will fight the sentence. If I had to bet, my money would go to the proposition that he won’t spend a day in the Texas Department of Corrections. Television quoted jurors saying that they threw the book at him because he didn’t show up for the hearing. Can’t say that Judge Ramsey (((a good judge))) is not earning his money.

    It would be nice if some of the $10,000,000 went to Roxanne’s House (the child abuse center in Hays County). They are the ones who help child abuse victims. That money would be well spent helping other abuse victims.

    Whatever the outcome I am sure that the Indian community of his followers will continue to shelter him for as long as he chooses. That is the nice thing about zealot followers – they do what you demand in order to secure your good graces in this life and the next, however many they believe that will be.

    do 12 year old have breasts? why swami was not allowed into his Ashran since 2008? there were no children in 2008….where were the girls parents? do they think swami was molester? if no,why not? why the girls came out now? what were this girls doing after they left the swamis ashram? what sort of life and character do they have? why were specialists not allowed by court to prove some children can make out stories? also,who runs the Ashram? who controls it in swamis absence? what are the assets of the Ashram? and what are the liablities against the Ashram property..?

    Danny, who cares if a 12 yr old has breast they were abused agains their will. This guy is at large and needs to be captured. It doesn’t matter what kind of character the victims have, jury found this man guilty on evidence we are not aware of and that is ALL that matters!! More to the story than you know. Duh!

    There is absolutely no question that the guru needs to be captured. But I am of the opinion that, since the case apparently rests totally on the testimony of these two ladies, these questions would have been relevant at the trial. The trial is over and, for the most part, the points raised are moot. But I would hope that somebody out there entertains the belief that some cases are virtually impossible to defend and, that being the case, extra care needs to be taken to insure that innocent people are not convicted. Accusations do not equal guilt.

    Please take the time to actually sit in on one of these type of trials someday and see for yourself what all is involved. Just so you know, Hays County is LUCKY to have the investigators and prosecutors that we have because they DO take their time to examine ALL the evidence and are competent enough to understand that sexual abuse rarely has any witnesses or DNA or recordings or whatever it is you think should be a part of a sexual abuse case. This crime is insidious by its very nature. These sexual offenders prey on the innocent and defenseless and they KNOW they have people like you on their wings waiting to defend their very name. THAT is a part of what keeps MOST victims silent. One other thing you should know is that most reported cases RARELY make it to the court room. It takes a lot of work to build a strong case. Every year there are hundreds of cases reported in this county, of those only a very small percentage make it to trial. So before you go jumping on these alleged “innocent accused” offenders, please KNOW that in THIS county, a great amount of work and to use your words CARE…has already been invested in figuring out just who may or may not be innocent.
    And to Danny, obviously you were not in attendance in this trial but the defense did all they could to attack these young women and they did have what you call “specialists”, I believe there were more than a dozen attorneys, “experts” and not to mention all his followers there trying what they could to get this man off. The jury who WAS there and heard ALL the evidence, THEY decided. THEY heard EVERYTHING, not just rumors that you may have been privy to or the few newspaper articles published. This trial was over two weeks long, even YOU can’t think you KNOW all of what they jury heard. So next time before you start asking your quite misguided inquiries, GO EDUCATE yourself first. Participate and see for yourself. Trial proceedings are OPEN to the public, no secrets behind closed doors as to how your tax dollars are being used. And then maybe you can register your opinion.

    When I started posting on this subect I made it clear that I knew nothing of the circumstances, heard no evidence, no testimony, and really know nothing about the case. In general, my idea is that the only concern is that justice be served. You make good points. I do worry about false accusations, but I have absolutely no idea that this accusation is/was false.     I felt highly dejected and grudged against God whenever i read in Bhagavatam and other Shastras (written by our ancient saints) that “people have huge physical, monetary and social sufferings for millions of lifetimes, who commit crime against a real saint”. But today I got my answers.
    The Jury had convicted a real saint as a criminal without any single valid proof. The statements of these girls have been opposed by their own parents and brother. Out of 1000′s of devotees of Swamiji no one had seen/felt that kind of act by him.
    Whether you believe in God or not, a day will definitely come (100%) where you have to pay for your deeds accordingly.

This guru Prakashanand Saraswati long ago put the fear of hell into this one mother that she would “go to hell for millions of lifetimes” and eventually come back to the world as a “reincarnated bug or animal” for supporting her victim daughter and the other victims. Once she struggled to get out of their oppressive hierarchical control and dictatorship she was harassed, stalked, bribed, slandered , threatened and ostracized herself. So Ms True Justice this is the true hallmark and nature of your corrupted religion. There’s nothing wrong with Hinduism–its a wonderful religion, but this one sect in particular is led by cons against whom “true justice” equals “law of the land” is making sure they do not continue to operate “above the law” again. -This quote “Barsan Dham is above the law” was twice touted in announcements to Barsana Dham devotees–once by the vice president, who must know how this convicted fugitive got away and where he is now. What does she know about the escape plan and why has she lawyered up?

    Danny, Brainwashing in this corrupt organization is done many ways. Abuse of power, authority, faith and and trust. At first everyone is nice and sweet to get you to join, but it doesn’t stay that way beyond the walls of the prayer hall and public spaces. Privately, all the ex-devotees I know will say they felt like they’ve been in a “psychological, emotional and spiritual jail” without gates. Scriptural indoctrination starts first. The swami says he’s a descension of God whose come to “grace” the devotees known in scriptures as “gopis” whom Lord Krishn “flirted” with.. He says he’s a “saint” and all JKP Barsan Dham preachers promote that once you’ve joined, or even before in recruiting . He writes H.D meaning (HIS DIVINITY ) before his name on every book he’s ever written–so he promotes himself as a “Divine” . You can see for yourself in Barsana Dham bookstore and all over their website and JKP Barsana Dham web blogs. This guru doesnt show it in the beginning, but insidiously turns into a tyrannical dictator with frequent fits of angry outbursts to discipline everyone. Then his hierarchy do the same, so there’s a gang of them helping him. In fact, suppression and oppression to devotees happens over decades and starts from day one when the devotee is not even aware of all the cons and tricks– such as the leader exploiting the scriptures with heavy indoctrination to suit his own needs in the long run. Starts off with fatherly or grandfatherly hugs in front of others and fun rides through the woods in a golf cart or old RV, or serving him a cup of tea in his bedroom, or fixing a sari fallen off a girls shoulder but hands slip, Then over the years, big time Control moves on from there. In part, his brainwashing is done the same way army sergeants drill soldiers. Once they join the army they have to follow all the Commanders’ orders, and jump to it, no matter whether they agree or not, and never answer back, never challenge or question his actions or words, or else suffer severe disciplining. That includes being cursed to go to hell and return in multiple next lives to suffer horrendously as a bug or an animal. And when you’re in hell, vulchers come and eat your entrails while you’re still awake, or you’re made to run on hot copper plates for hours in bare feet. I only recently discovered this latter threat was told to children when they were younger in a school holiday camp for those who lived at the temple. It goes on and on, and would take a book to describe how brainwashing controls, like other infamous culprits have done and proven to make horrible history worldwide. Just like recent news–how did people stay in the sweat lodges till they died– because they were told to stay by their guru? Similar principle, but just one example of hundreds..

    @Lasmith, right on! Such a true and profound statement. JKP and Barsana Dham and all its leaders and enablers are truly abusing the US and Texas constitutions’ Freedom of Religion –when violating a member, they also violate these very constitutions. Such a constitution does not however give anyone carte blanche privilege and freedom to molest, violate and abuse the mind, body and emotions of the followers. All churches regardless of denomination including those “minority” religions who hide under the banner of “freedom of religious expression” must, above all, still obey the laws of the Stater of Texas and the US which preside over these constitutions. There should be a law against those who abuse and violate these constitutions and the place in which the abuse took place should be shut down, even if it is a temple or church.

    Well, I for one can say that Hays county does not do their homework in investigations, nor do most courts in central Texas. Although I am not Hindu, I am fascinated with the religion. It’s sad that these stories came about. But with no physical evidence and with this much time having lapsed since the event (this was 18 years ago, allegedly), I’m not certain where the jury is thinking so much time in prison.

    Clearly, this doesn’t speak for all the members of Barsana Dham, nor even I who frequent once a year for the celebrations and sense of rich tradition.

    It really is sad, because I wanted to go to the Holi Festival there this year. But it seems as if they’ve canceled.
