Two San Marcos men are accused of attacking their brother-in-law and fracturing his jaw in retaliation for breaking his wife’s nose earlier this fall, police records show.
Robert Rodriguez, 30, and Vincent Rodriguez, 27, were arrested last month for the September incident in which they allegedly assaulted 23-year-old Kevin Perez, an arrest affidavit says.
Perez was transported to Central Texas Medical Center in San Marcos. There, he told police that his wife sent her brothers to their home to attack him for a previous assault on her, Perez admitted in the police report.
Around midnight on Sept. 6, Perez answered the door and saw the Rodriguez brothers with two other unidentified males. Perez told police the four men entered his home and Robert grabbed him in a headlock while the other men punched and kicked his face, back and chest, the affidavit says.
In the midst of the beating, Perez recalled that he could hear Robert and Vincent saying, “Get him, hit him in the face … Don’t mess with my sister.” The four men then stopped and fled in a white Plymouth, according to the affidavit, written by San Marcos police Det. Sandra Spriegel.
On Dec. 14, police attempted to serve a felony warrant at the Rodriguez home where they say they met resistance from the father. Once he opened the front door, police say that Roberto Rodriguez, 54, failed to identify a man who could be seen sitting on a couch in the background. Roberto informed police that the man was just a friend and wouldn’t answer follow-up questions from officers, the report says.
Police asked the man to come to the front door. They identified him as Robert and handcuffed him. As police advised the father that he was also under arrest, the father tried to slam the door on officers and flee into his home. Officer Lee Harris blocked the door and detained the man with his taser gun, says the affidavit, written by Harris.
When the dust settled, Roberto Rodriguez was charged with hindering the apprehension of a felon, a third-degree felony. His sons, Robert and Vincent Rodriguez, were charged with aggravated assault causing serious bodily injury, a second-degree felony. All three men were released the next day on bonds from $5,000 to $10,000, jail records show.
A few days later, Perez was also charged with aggravated assault causing serious bodily injury. He is out on bail on a $10,000 bond, records show. As there was no arrest affidavit, it is unclear whether Perez’s arrest relates to the alleged assault on his wife.
In addition, police records did not specify whether the other two men involved in the beating had been identified or arrested.
