A Kyle man has been arrested and charged with four counts of aggravated sexual assault of a child for alleged abuses taking place over a four-year span.
David Michael Kelley, 31, admitted at the Hays County Sheriff’s Office on Feb. 7 that he had sexual contact with a child, after the 11-year-old girl complained of sexual abuse, according to an affidavit of probable cause.
According to the affidavit, the child alleged that Kelley came into her room, removed her clothes and performed sexual activities on her.
A child forensic interview was conducted on the alleged victim at the Child Advocacy Center Roxanne’s House in San Marcos on Feb. 6.
“The child victim stated that David Kelley began coming into her room just before her birthday party when she turned 7 years old which would have been in 2009, and the last time that it happened was in December of 2012,” the affidavit said. “Victim child stated that David Kelley would come into her room 1 to 2 times a month.”
The affidavit described Kelley’s sexually explicit admission of abuse and went on to say , “Kelley stated that when he was finished he would tell the victim child to get dressed and go back to sleep.”
Kelley told authorities he had been having sexual intercourse with the child “for a long time,” according to the affidavit, and he corroborated the child’s statement that “he would go into her room one to two times a month.”
Kelley was arrested on the felony charges after Justice of the Peace Beth Smith issued a warrant on Feb. 8. Jail records show he remains in custody on a $400,000 bond.
