Two Buda brothers accused of assaulting and mugging a 93-year-old man last September each have been sentenced to 15 years in prison.
Forrest Kubsch, now 21, pled guilty and received his sentence on Jan. 14. His younger brother Ethan Kubsch, now 18, also pled guilty and was sentenced on Feb. 25.
Still awaiting trial are Johnmichael Swann, now 19, of Buda, and Christopher Garcia, 19, of Kyle.
Investigators say the four boys robbed 93-year-old Buda resident Allie Wright, hitting him in the stomach and restraining him during the crime. The attack occurred in the brushy, sparsely populated area around Garrison Road.
Wright did not suffer any lasting injuries. Aggravated robbery of a person over the age of 65 is a first degree felony.
Hays County District Attorney Sherri Tibbe declined to comment on any possible plea bargains for Garcia and Swann, citing the upcoming trials.
“A 93-year-old man is brutally robbed – I think it speaks for itself,” Tibbe said.
Swann and the Kubsch brothers already have lengthy criminal histories. Last January, Swann, Forrest Kubsch and a juvenile whose name was not released were arrested and charged with two counts of Burglary of a Habitation after they allegedly stole about $2,000 worth of jewelry, electronics, alcohol and cash from two homes in the Bonita Vista neighborhood. They were also suspects in other cases, Kidd said.
“They go back a long way,” said Buda Patrol Chief Bo Kidd. “I think they were inclined to continue criminal activity, were they out and about.”
Kidd said he was pleased with the verdict and the speedy process.
“I think they were certainly deserving of a 15-year sentence,” Kidd said.
Wright, an elderly African American man known for driving around Buda on a riding lawn mower, was born nearly a century ago in a small house on Garrison Road with dirt floors, a corrugated tin roof and an outdoor bathroom. When that house burned down in 2005, members of the Buda community pooled their resources to construct him a new home.
